Just a few thoughts regarding the NDAA amendments on the issue of indefinite detainment of US citizens. Lawmakers should have NO hesitation in clarifying the issue, apparently they do. Some surprising sources say the bill no longer authorizes the indefinite military detention of Americans captured in the US. I believe that is incorrect and here's why,
The Feinstein amendment would have banned indefinite detention of US citizens by US government, it was clear language but it was not approved (45-55). The Senate came up with and passed a "compromised amendment" that some say will protect due process; I do not agree. The compromised amendment says  NDAA should not be construed to affect 'existing law' relating to the detention of United States citizens. Rather than clarify the issue, Congress put the issue on 'existing law'. Don't they make laws?
So here's the problem. Lower courts are conflicting and SCOTUS hasn't ruled on the issue as in the case of Jose Padilla (see Rumsfeld v. Padilla). Jose Padilla, a US citizen that was captured INSIDE the US and was held in military prison for years, without charge, after George W Bush declared him an 'enemy combatant'. The Supreme Court of the United States took the case of Rumsfeld v. Padilla to decide the question of whether Congress's Authorization for Use of Military Force authorized the President to detain a U.S. citizen, but SCOTUS never ruled on the issue, they just said the case was improperly filed. There is also the 1940s case where a US citizen was prosecuted by the military and executed; SCOTUS said it was legitimate. So recent actions or existing law doesn't look so good. Liberty, whether it's the SCOTUS-approved-military-killing-of-citizen or the conflicting lower court cases... I'm not sure what existing law are they referring to because SCOTUS never ruled on Padilla which happened because POTUS ignored the Non-Detention Act (see 'References' here). Why the hell can't they just clarify the law? They are lawmakers! Oh yeah, the military state is the agenda.
I can't see any protection from the 'comprised amendment' so if anyone can assure me otherwise, please do. I'd love to be wrong on this! Bottom line, this was their opportunity to clarify citizens are immune to indefinite detention or military prosecution, THAT IS THEIR JOB, and they blew it. Obama and the Senate refuse to make it clear. We should look at what lawmakers do as opposed to what they say, as it has been made clear time after time that they do not follow the Rule of Law. So we're left with the Jose Padilla case, an infinite loophole at best, and DUE PROCESS IS NOT PROTECTED. It is too easy to say indefinite detention does not apply to US citizens, or that US citizen has the Right to civilian court, but they won't! It begs the question,
WHY are federal lawmakers so hell bent on not protecting our most basic Rights and overturning the Constitution?
Every American should be very concerned when federal lawmakers will not clarify the law relating to indefinite detention of US citizens!
Remember, Hitler's Germany made laws to remove Human Rights of Jews... before he made laws to imprison them... before he killed them. The globalist agenda keeps marching towards the New World Order and they're taking big steps with this treasonous bill! I know a lot of our wonderful military men and women will not obey such awful orders that could be coming our way (military detainment of citizens isn't for lone wolves), but should we really leave it to them to face court martial? Or should we OCCUPY OUR RIGHTS? NOW! GO to DC before this bill becomes law! Demand clear language to exclude US citizens from detention by military, indefinite or otherwise! The House has already approved it but the House and Senate have to combine the two bills.
